My husband is forced to pay child support for a child who is not his, the payments have already started

She is adamant it is a clerical error because her partner was only ten years old when the toddler in question was born.

She shows the letter her husband received saying he has to pay child support in the TikTok Video and told how the money was already taken when they had just received the letter.

In the video, Rosa says, “When your husband receives a letter in the mail saying that money will be taken from his paycheck to pay for child support.

“Only to see that the child was born in 07 and that your husband was 10 years old at the time.

“Bad baby daddy.”

The letter makes it clear that her husband would be forced to pay almost $ 600 (£ 430) a month in child support.

Rosa says the baby was born in 2007, but her husband was only ten years old at the time, implying that it would be impossible for her to be the father.

“So because they had the matching name, they were automatically like oh yeah it’s baby daddy.”

In response to the many questions they received about how this situation came about, Rosa uploaded two more videos. to explain how it all happened.

She said: “The lady lives in Texas with her son, and the only reason the letter was sent to her was because baby daddy doesn’t have a social number (social security number).

“So because they had the matching name, they were automatically like oh yeah it’s baby daddy.

“They told my husband the guy isn’t here in the country anymore, so there’s no way to find him.

“He (her husband) called the lawyer and let them know like ‘I’m not the father’ and they said send his ID and he showed proof of his date of birth and they told him okay, well the money’s already withdrawn, you’re going to have to wait for us to pay it back.

According to Cordell Cordell, a national litigation firm, under Texas child support laws, if you pay child support, that equals 20 percent of your monthly income.

A court can order a parent to support a child until he or she turns 18 or has graduated from high school.

The process of opening a child support claim is relatively easy to do in Texas, says Sisemore Law Firm, asking for the forms and applying online or in person and giving as much detail as you know about yourself and the other parent.

Then the child support office will hold a negotiation conference with the other parent. If no agreement is reached, it will be transferred to government courts.

But apparently this was not the case for Rosa’s husband, Rosa claims that they did not receive any prior mail regarding child support until the letter came in and the money was taken.

She also said, “The Texas child support office is going to receive it and when it does, it will pay it back.

“I mean that’s all they’re going to do, we just have to wait for the refund now, we just don’t know how long it’s going to take, I think they told us six to eight weeks. “

In a separate video, Rosa tried to debunk the fact that the baby couldn’t be her husband’s and that they had not received any prior mail to the letter, after viewers were skeptical of the story.

“To people who say he should pay child support and that he could still have a child at ten, like no.

“The lady who is the mother of the child had a child in 2007, my husband was ten and she was 35, so there is no way my husband at ten would be with a 35-year-old man. , it just doesn’t match.

“He’s not her kid, we just think it’s funny, the only reason was he had the same name.”

“Also add, to the people who said oh, they usually give you a letter saying he needs to take a DNA test, he literally didn’t get any mail.”

Many people were shocked by Rosa’s claim, one user wrote; “How do they do this without verifying that it’s him, that’s the real problem.”

The most popular comment was: “How do you steal someone’s money without verification?” “

People in the comments claimed that they have also encountered similar issues or know of people who have had them.

One user wrote: “It happened to my husband !! He apparently owed $ 60,000 in child support! When the 1st child was born my husband was 7 years old and in Mexico !! Smh. “

Another replied: “Lmao, it happened to my brother, it was the funniest thing because the kid was born when he was 3 years old.”

A third commented, “I thought they were doing DNA testing before they put the father on child support.”
